Prohibited Items and Conduct

This Prohibited Items and Conduct policy is incorporated in full into our Terms and Conditions, and any other applicable disclosures and agreements made available by Kafene, Inc. (“Kafene”).


Items belonging to the categories listed directly below are barred from using the services (the “Services”) offered by Kafene (“Prohibited Items”). By using any of our Services, you confirm that you will not use our Services to transact in connection with the following items:

• Motor vehicles (including Scooters, ATVs, UTVs, Golf Carts, 4 Wheelers, 3 Wheelers, Dirt Bikes, and anything that would require a title)
• Car parts (excluding lift kits and accessories)
• Auto repair
• Mobile phones
• Scooters
• Firearms and other weapons, and ammunition
• Pets or other animals
• Counterfeit products or any product that infringes upon the copyright, trademark, or trade secrets of any third party
• Products for commercial use
• Stolen goods
• Narcotics, controlled substances, prescription and pharmaceutical services, drug paraphernalia, or any substances designed to mimic illegal drugs
• Anything not deemed a physical product or merchandise, such as labor or service work (with the exception of a delivery fee provided that such delivery fee is part of the same transaction whereby the item is leased)
• Anything prohibited by Kafene’s policies or by applicable law

You may not use our Services to engage in any of the following:

• Violating, or assisting any party in violating, any applicable law, statute, ordinance, regulation or any rule of any self-regulatory or similar organization.
• Any deceptive marketing practices.
• Using our Services to sell or lease any of the Prohibited Items.
• Using our Services to sell or lease any merchandise over the phone or online.
• Any action set forth as Prohibited Actions in our Privacy Policy.
• Any transaction which involves the proceeds of any unlawful activity.
• Any transaction involving online gambling.
• Defrauding or attempting to defraud anyone.
• Infringing upon Kafene’s or any third party’s intellectual property rights.
• Providing false, inaccurate or misleading information.
• Leasing a particular item in combination with any other lease or rent to own service or agreement.
• Issuing a lease where the delivery fee exceeds 30% of the lease value.
• Marking a lease as delivered before delivery is complete.
• Interfering with another individual’s or entity’s access to or use of any part of our Services.
• Defaming, abusing, harassing, stalking, threatening or otherwise violating or infringing the legal rights of Kafene or any other person or entity.
• Publishing, distributing or disseminating any defamatory material regarding our Services or unlawful material or information.
• Transmitting or uploading any viruses, Trojan horses, worms, or any other malicious programsCompromising our Services, computer systems or networks through any means.
• Engaging in any violent acts towards self or others, or in any activities that encourage, promote, facilitate or instruct others to do the same.

No employee, owner, or family member of an employee or owner of a Kafene merchant partner may use our Services to create an application or lease in their own name or with their own contact or banking information.
